DONATION REGULATIONS
OF BAPTYSTYCZNA AKCJA CHARYTATYWNA
dated 17 July 2026
This document is an English translation of the Polish-language Donation Regulations of Baptystyczna Akcja Charytatywna. It has been prepared for informational purposes. In the event of any discrepancy or difference in interpretation, the Polish-language version shall prevail.
§ 1. General provisions

These Regulations set out the rules for making monetary donations to Baptystyczna Akcja Charytatywna, also operating in English as Polish Baptist Aid, with its registered office in Warsaw, at ul. Waliców 25, 00-865 Warsaw, Poland, NIP: 5272899425, REGON: 383907625, hereinafter referred to as “BACh”.

BACh conducts church charitable and welfare activities in accordance with the Act of 30 June 1995 on the Relationship between the State and the Polish Baptist Union and in accordance with the Statutes of BACh.

The website operating under the domain www.akcjabach.org is maintained and administered by BACh.
-
Donations made to BACh are used to finance its church charitable and welfare activities and other statutory activities of BACh, including activities conducted as part of its public benefit activities.

A donation may be made by an individual legally capable of making a donation, a legal entity or an organisational unit, hereinafter referred to as the “Donor”.
-
Making a donation is voluntary and does not entitle the Donor to receive any consideration or reciprocal benefit from BACh.

By making a donation, the Donor accepts these Regulations to the extent applicable to the selected method of making the donation.
§ 2. Methods of making donations
-
Donations to BACh may be made in particular:
-
through donation forms available on the BACh website and processed by external electronic payment operators;
-
by direct bank transfer to a BACh bank account;
-
through online fundraising portals and platforms, including in particular www.zrzutka.pl, or other services enabling online fundraising campaigns to be organised and processed;
-
in cash to a person authorised by BACh;
-
as part of collections conducted using collection boxes, stationary donation boxes or other appropriately secured containers;
-
through other payment methods made available by BACh.

Donations may be made as:
-
one-time donations;
-
recurring donations;
-
donations without a specific designated purpose;
-
donations for a specific project, programme, fundraising campaign, event or another purpose indicated by BACh or the Donor.

The Donor shall bear any costs associated with making the payment in accordance with the rules applied by the Donor’s bank, payment operator or other payment service provider.
§ 3. Donations made through the website
-
Through the BACh website, the Donor may make one-time donations and, where such an option is available, recurring donations.
-
To make an online donation, the Donor completes the donation form available on the BACh website and is then redirected to the website of the entity processing the payment.
-
The Donor may select one of the suggested donation amounts or enter another amount of their choice.
-
Online donations may be processed by one or more external electronic payment operators, hereinafter referred to as “Payment Operators”.
-
A Payment Operator is an entity providing services that enable electronic payments and that is identified to the Donor in the donation form or on the website to which the Donor is redirected in order to complete the payment.
-
BACh may use the services of Payment Operators such as PayPal, PayU, Przelewy24, Skrill or other entities providing electronic payment processing services.
-
Current information about the Payment Operator processing a particular transaction is made available to the Donor before the payment is completed.
-
The available payment methods depend on the current offer of the relevant Payment Operator and may include in particular:
-
payment cards;
-
electronic bank transfers;
-
BLIK payments;
-
electronic wallets;
-
recurring payments;
-
traditional bank transfers;
-
other payment methods made available by the Payment Operator.

Not all of the payment methods listed above must be available at all times.
-
The detailed rules for processing payments, including payment authorisation and security requirements, are set out in the terms and conditions of the Payment Operator processing the relevant transaction.

BACh does not store full payment card details or other confidential data used to authorise payments. Such data is transferred directly to the Payment Operator and processed in accordance with the rules applicable to that Payment Operator.
§ 4. Donations made through fundraising portals
-
BACh may organise or conduct fundraising campaigns through external online fundraising portals and platforms, including in particular www.zrzutka.pl, hereinafter referred to as “Fundraising Portals”.

Current information about the Fundraising Portal used for a particular fundraising campaign is available on the relevant campaign page.
-
Making a donation through a Fundraising Portal may require the Donor to accept the terms and conditions, privacy policy or other rules applicable to that Fundraising Portal.

The detailed rules concerning the technical processing of payments, fees, refunds, transaction security and the processing of data by the Fundraising Portal are governed by the documents applicable to that Portal.

Donations made through a Fundraising Portal shall be used in accordance with the purpose and description of the relevant fundraising campaign, subject to § 8 of these Regulations concerning surplus funds, unused funds and circumstances in which the stated purpose cannot be carried out.

Where the terms and conditions of the Fundraising Portal, the description of the relevant campaign, a separate agreement or applicable law provide for specific rules concerning the use or refund of funds, those rules shall prevail over the general provisions of these Regulations.

BACh shall not be liable for the temporary unavailability of a Fundraising Portal, technical problems concerning the operation of the Portal or other circumstances outside the control of BACh.
§ 5. Recurring donations

A recurring donation consists of the regular transfer to BACh of an amount declared by the Donor, generally once a month, using the selected payment method.
-
By setting up a recurring donation, the Donor authorises the regular charging of the designated payment card or another payment instrument with the declared donation amount.

The Donor may cancel a recurring donation at any time using the method indicated by the Payment Operator or by contacting BACh at: kontakt@akcjabach.org

The subject line of the message should state “Cancellation of recurring donation”, and the message should include information enabling BACh to identify the payment, in particular:
-
the Donor’s full name;
-
the email address provided when the recurring donation was set up;
-
where possible, the amount of the donation.
-
-
BACh shall take steps to stop subsequent payments without undue delay after receiving a complete request.
-
Due to the technical processing of payments, a transaction initiated before the cancellation request was received or processed may still be completed.
-
Cancellation of a recurring donation does not result in the automatic refund of donations made before the cancellation became effective.
§ 6. Donations made directly to a bank account
-
A donation may be made directly to a BACh bank account indicated on the BACh website, in BACh informational materials or in information provided individually to the Donor.
-
The Donor may indicate the purpose of the donation in the payment reference or bank transfer description.
-
Where the Donor does not indicate a specific purpose, the donation shall be used for the donation shall be used for the statutory activities of BACh.
-
Where the purpose indicated by the Donor is unclear, cannot be identified, is contrary to law or falls outside the scope of BACh activities, BACh may:
-
contact the Donor to clarify the intended purpose of the donation, provided that BACh has the Donor’s contact details;
-
use the donation for a purpose that most closely corresponds to the description provided by the Donor;
-
use the donation for the general church charitable and welfare activities of BACh;
-
in justified circumstances, return the donation to the bank account from which it was transferred.

BACh is not required to carry out a purpose unilaterally indicated by the Donor if that purpose has not previously been announced or accepted by BACh, is impossible to carry out or falls outside the scope of BACh activities.
§ 7. Cash donations and collection boxes
-
Cash donations may be accepted by persons authorised by BACh.
-
A Donor making a cash donation directly to an authorised person may request written confirmation that the donation has been received.
-
In order for such confirmation to be issued, the Donor should provide information enabling their identification and confirming the amount and date of the donation.
-
BACh may conduct monetary collections using collection boxes, stationary donation boxes or other appropriately secured containers.
-
A collection box or donation box should be appropriately marked, in particular by identifying the organiser and the purpose of the collection.
-
Where a collection constitutes a public collection within the meaning of applicable law, it shall be conducted, documented and accounted for in accordance with the applicable legal provisions and the purpose stated in the public collection notification.
-
In the case of anonymous donations placed in collection boxes or donation boxes, BACh is unable to issue individual donation receipts.
§ 8. Donations for a specific designated purpose
-
BACh may inform Donors that donations are being collected for a specific designated:
-
project or programme;
-
event;
-
type of assistance;
-
group of beneficiaries;
-
purchase;
-
fundraising campaign;
-
other purpose connected with the church charitable and welfare activities of BACh.

Information about the purpose of a donation may be provided in particular:
-
on the BACh website;
-
in the donation form;
-
through social media;
-
in an email;
-
in printed materials;
-
alongside the relevant bank account number;
-
on a collection box or donation box;
-
during an event at which donations are collected.
-
-
BACh shall use donations received for a specified purpose primarily to carry out that purpose.
-
The Donor acknowledges that the scope, schedule, manner of implementation and budget of a project may change depending on:
-
the actual needs of beneficiaries;
-
the amount of funds raised;
-
the actual costs of implementing the project;
-
organisational circumstances;
-
the number of people receiving assistance;
-
other circumstances affecting the possibility of carrying out the project.

BACh may use all or part of the funds raised for other activities that are as closely related as reasonably possible to the original purpose of the donation where:
-
the amount raised exceeds the budget required to carry out the specified purpose;
-
unused funds remain after the project has been completed;
-
the specified purpose has been financed in whole or in part from other sources;
-
implementation of the project becomes impossible, excessively difficult, unjustified or no longer appropriate;
-
the project is cancelled, completed, reduced in scope or materially modified;
-
the need for which the funds were raised ceases to exist or proves to be smaller than originally anticipated.

Where it is not possible or reasonable to use the funds for a purpose similar to the original purpose, BACh may use them for other church charitable and welfare activities conducted by BACh, according to current needs.
-
Information concerning the possibility of using surplus or unused funds for other activities may also be included in the description of a particular fundraising campaign or project.
-
Where reasonably possible, BACh shall inform Donors of any material change in the use of the funds through its website, by email, through social media or by another appropriate means of communication.

The provisions of paragraphs 4–8 shall not apply to the extent that:
-
BACh has entered into a separate agreement with the Donor requiring the donation to be used exclusively for a strictly defined purpose;
-
the obligation to use the funds for a particular purpose arises from applicable law;
-
the funds were collected as part of a public collection and must be accounted for in accordance with the purpose stated in the public collection notification;
-
other documents binding upon BACh require the funds to be used differently.

§ 9. Donations without a specific designated purpose
-
Donations made without a specific designated purpose shall be used for the statutory activities of BACh.
-
BACh shall determine the detailed use of such donations, taking into account in particular:
-
the current needs of beneficiaries;
-
the needs of programmes and projects conducted by BACh;
-
the need to ensure the continuity of charitable activities;
-
the possibility of using the funds effectively and responsibly.
-

Donations may be used both to provide direct assistance to beneficiaries and to cover costs necessary for the preparation, organisation, operation, administration and accounting of the church charitable and welfare activities of BACh.
§ 10. Confirmations, statements and information about the use of donations
-
BACh may send the following information to the correspondence address or email address provided by the Donor:
-
confirmation that the donation has been received;
-
information about how the donation has been recorded or designated;
-
periodic or annual statements of donations received;
-
a report or information concerning the use of the donation;
-
information about the implementation of the project, programme or fundraising campaign for which the donation was made;
-
a request to supplement or clarify information required for the proper accounting of the donation;
-
information about a material change in the use of the donation in accordance with § 8 of these Regulations.

A Donor who voluntarily provides BACh with their email address when making a donation or after the donation has been made agrees that BACh may use that address to contact the Donor in matters relating to the donation, in particular for the purposes listed in paragraph 1.
-
The consent referred to in paragraph 2 covers communication relating to the processing, confirmation and accounting of the donation and the provision of information about how it has been used.

The Donor may at any time request that BACh stop sending information about the use of the donation by contacting: kontakt@akcjabach.org
-
Withdrawal of consent does not affect the lawfulness of any processing carried out before the consent was withdrawn, nor does it affect BACh’s ability to process data to the extent necessary to comply with legal, accounting or tax obligations or to establish, pursue or defend legal claims.

In the case of online donations, BACh may send confirmation that the donation has been received to the email address provided by the Donor in the donation form.

BACh may send the Donor an annual statement of donations received within 60 days after the end of the calendar year, provided that BACh has information enabling it to identify the Donor and has the Donor’s email address.
-
In the case of a donation made directly to a bank account, the bank transfer confirmation shall constitute the primary evidence that the donation was made.
-
At the Donor’s request, BACh may issue additional confirmation that the donation was received, provided that the Donor and the relevant payment can be clearly identified.
§ 11. Information concerning the deduction of donations
-
Donations made for church charitable and welfare activities may be deductible from taxable income in accordance with applicable law.
-
Eligibility for such a deduction depends on the Donor satisfying the requirements provided by law, including holding appropriate documents confirming that the donation was made and showing how it was used.

Where the Donor does not indicate another purpose, BACh shall treat the donation as having been made for its statutory activities.
-
BACh shall issue documents concerning the receipt and use of donations within the scope and time limits required by applicable law.
-
The information contained in these Regulations does not constitute individual tax advice.
§ 12. Processing of personal data
-
The controller of the Donors’ personal data is Baptystyczna Akcja Charytatywna, with its registered office in Warsaw.
-
Donors’ personal data may be processed in particular for the following purposes:
-
accepting, processing and accounting for the donation;
-
identifying the Donor and the payment made;
-
issuing and sending confirmation that the donation has been received;
-
preparing and sending statements of donations;
-
providing information about the use of the donation;
-
complying with BACh’s accounting, tax and legal obligations;
-
handling complaints and requests;
-
establishing, pursuing or defending legal claims;
-
conducting communications for which the Donor has provided separate consent, where such consent is required.

Providing personal data is voluntary but may be necessary in order to:
-
use a particular payment method;
-
receive confirmation or a statement of donations;
-
receive information about the use of a donation;
-
have a complaint or other request considered.
-
-
Data required to process a payment or make a donation may also be processed by the Payment Operator, the Fundraising Portal, the bank and other entities involved in completing the transaction.
-
Detailed information concerning the processing of personal data, the applicable retention periods and the rights of Donors is set out in the Privacy Policy available at www.akcjabach.org.
§ 13. Payment problems and complaints

Problems relating to making a donation may be reported to:
-
The Donor may submit a complaint concerning the processing of a donation.
-
The complaint should be sent to kontakt@akcjabach.org with the subject line “Complaint”.
-
Where possible, the complaint should include:
-
the Donor’s full name or legal name;
-
the Donor’s email address;
-
the date and amount of the transaction;
-
the payment method;
-
a description of the problem;
-
information enabling the transaction to be identified.
-
-
Complaints shall be considered individually, generally within 14 days of receiving a complete complaint.
-
Where additional information is required in order to consider the complaint, BACh may ask the Donor to provide such information.
§ 14. Refunds of donations
-
Due to the nature of a donation, funds donated to BACh are generally non-refundable.
-
In justified circumstances, the Donor may request a refund, in particular where:
-
the donation was made by mistake;
-
an incorrect amount was donated;
-
the same payment was made more than once;
-
a technical error occurred;
-
the transaction was made without the consent of an authorised person.

The request should be sent to kontakt@akcjabach.org and should include information enabling BACh to identify the donation and the reasons for requesting the refund.
-
Each request shall be considered individually, taking into account the circumstances of the case, applicable law and whether the funds have already been used.
-
Where a refund is approved, it shall generally be made using the same payment method or to the bank account from which the donation was transferred.
§ 15. Liability
-
BACh shall not be liable for problems with processing a payment resulting from:
-
the actions or systems of the Donor’s bank;
-
the actions or systems of the Payment Operator;
-
the actions or systems of the Fundraising Portal;
-
incorrect information provided by the Donor;
-
insufficient funds in the Donor’s account;
-
failures of systems outside the control of BACh;
-
other circumstances for which BACh is not responsible.

BACh shall exercise due care to ensure that information concerning projects, fundraising campaigns, their budgets and the planned use of donations is current and reliable.
-
Project and fundraising budgets may be estimates and may change depending on actual costs, the number of beneficiaries and the circumstances in which the relevant activity is implemented.
§ 16. Amendments to the Regulations

BACh may amend these Regulations, in particular in the event of:
-
changes in applicable law;
-
changes in the methods used to make or process donations;
-
the replacement or addition of a Payment Operator or Fundraising Portal;
-
the introduction of new forms of support;
-
the need to clarify the provisions of these Regulations.

The amended Regulations shall be published on the BACh website together with the date on which they take effect.
-
Amendments to the Regulations shall not affect rights acquired by Donors before the amendments take effect.
-
A donation shall be governed by the version of the Regulations in force on the date on which the donation was made, subject to any mandatory provisions of applicable law.
§ 17. Postanowienia końcowe
-
These Regulations are available on the website www.akcjabach.org.
-
Matters not regulated by these Regulations shall be governed by Polish law.
-
Where a donation is covered by a separate agreement entered into with the Donor, the provisions of that agreement shall prevail over these Regulations.
-
In the case of public collections, the provisions of the public collection notification and the laws governing the conduct and accounting of such collections shall prevail over these Regulations.
-
If any provision of these Regulations is found to be invalid or unenforceable, this shall not affect the validity or enforceability of the remaining provisions.

These Regulations shall enter into force on 24 July 2026.
